Notice of passing for a proposed zoning by-law amendment at 109 Reynolds Street for JRB - 109 Holdings Ltd.

Council passed zoning by-law 2020-043 under section 34, of the Planning Act, R.S.O. 1990, c. P.13, as amended on September 8, 2020.

The purpose and effect of zoning by-law 2020-043 is to rezone the property from CBD to MU2 permitting a maximum of six storeys consistent with the MU2 height permissions.  In addition, the by-law recognizes that the site is eligible for Bonusing an additional two storeys, for a maximum of eight storeys total, subject to the applicant entering into a Section 37 Agreement with the Town of Oakville.

The subject land is located east of Reynolds Street, south of Church Street.

The subject land is also subject to a Site Plan application under the Act for (File No. SP1613.108/01).

Council’s decision reflects that the comments from the public have been appropriately addressed.

Any appeals to the proposed zoning by-law amendment must be filed with the Town Clerk at 1225 Trafalgar Road, Oakville, ON, L6H 0H3; must set out the reasons for the appeal; and must be accompanied with a certified cheque or money order in the amount of $300.00 payable to the Minister of Finance.  A copy of the appeal form is available from the Local Planning Appeal Tribunal website at http://elto.gov.on.ca/tribunals/lpat

Only individuals, corporations and public bodies may appeal a by-law to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Town of Oakville Council c/o the Town Clerk (at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 or at TownClerk@oakville.ca) or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
