Revised notice of passing for a proposed zoning by-law amendment at 1429 Dundas Street East for Mattamy (Joshua Creek) Limited

Council passed zoning by-law 2020-018 under section 34, of the Planning Act, R.S.O. 1990, c. P.13, as amended on March 9, 2020.

Pursuant to Section 4 of  O.Reg. 149/20 – Special Rules Relating to Declared Emergency, filed April 15, 2020, Notice of this decision previously given is deemed not to have been completed. The last day for filing an appeal is now May 19, 2020, being 20 days after circulation of this revised notice.

The purpose and effect of zoning by-law 2020-018 is to reconfigure the existing Park Zoning, Sub-Urban and General Urban Zoning as it relates to the Village Square and abutting residential lots.

Council has fully considered all the written and oral submissions relating to this matter and that those comments have been appropriately addressed.

The subject property is generally located north of Dundas Street, west of Ninth Line.

These lands are also subject to the zoning application Z.1307.05.

Any appeals to the proposed zoning by-law amendment must be filed with the Town Clerk at 1225 Trafalgar Road, Oakville, ON, L6H 0H3; must set out the reasons for the appeal; and must be accompanied with a certified cheque or money order in the amount of $300.00 payable to the Minister of Finance.  A copy of the appeal form is available from the Local Planning Appeal Tribunal website.

Only individuals, corporations and public bodies may appeal a by-law to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Town of Oakville Council c/o the Town Clerk (at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 or at TownClerk@oakville.ca) or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
