Notice of Passing
Council passed zoning by-law 2022-013 under section 34, of the Planning Act, R.S.O. 1990, c. P.13, as amended on Monday, March 7, 2022.
The purpose of zoning by-law 2022-013 is to rezone the subject lands to a site-specific Mixed Use 1 zone to permit a retirement home, with a restaurant at grade along Kerr Street, and a maximum building height of 6 storeys with bonusing together with site-specific building setbacks.
The effect of zoning by-law 2022-013 is to redevelop the subject lands with a six storey retirement home with 230 suites inclusive of memory care, assisted living and independent living. All suites are proposed to be rental in tenure. 110 parking spaces are proposed with limited surface parking along Wilson Street and most of the proposed parking located below grade. Outdoor amenity space is proposed toward the center of the site which would consist of a memory care garden court, an outdoor terrace, and a dining area backing onto Westwood Park.
The subject land is located north of Rebecca Street between Kerr Street and Wilson Street.
Council’s decision reflects that the comments from the public have been appropriately addressed.
Any appeals to the proposed zoning by-law amendment must be filed with the Town Clerk at 1225 Trafalgar Road, Oakville, ON, L6H 0H3; must set out the reasons for the appeal; and must be accompanied by the fee required by the Ontario Land Tribunal. A copy of the appeal form is available from the Ontario Land Tribunal website.
Only individuals, corporations and public bodies may appeal a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Town of Oakville Council c/o the Town Clerk (at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 or at TownClerk@oakville.ca) or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
