Notice of Refusal Proposed Official Plan and Zoning By-law Amendments
Council has made a decision to refuse the application for an official plan amendment and zoning by-law amendment submitted by Graywood Bronte Village LP under sections 22 and 34, of the Planning Act, R.S.O. 1990, c. P.13, as amended on July 11, 2022.
The purpose and effect of the proposed official plan amendment and zoning by-law amendment is to permit a nine-storey mixed use building with 180 residential units, and 673 square metres of commercial space at grade, with two levels of underground parking.
Council supports the recommendation of Staff as set out in the Staff Report dated June 28, 2022.
Council has fully considered all written and oral submissions relating to this matter and that those comments have been appropriately addressed.
Any appeals must be filed with the Town Clerk at 1225 Trafalgar Road, Oakville, ON, L6H 0H3; must set out the reasons for the appeal; and must be accompanied by the fee required by the Ontario Land Tribunal. The appeal form is available from the Ontario Land Tribunal website.
A person or public body that requested an amendment to the official plan of the Town of Oakville may appeal the refusal of the requested amendment to the to the Ontario Land Tribunal in respect of all or any part of the requested amendment by filing a notice of appeal with the Town Clerk.
Only individuals, corporations and public bodies may appeal a decision of the approval authority to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted and the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Town of Oakville Council c/o the Town Clerk (at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 or at TownClerk@oakville.ca) or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
The decision of Council is final if a notice of appeal is not received before or on the last day to appeal.
