Notice of Statutory Public Meeting on January 15, 2018, proposed Zoning By-law Amendment, Short-term Accommodations and Bed & Breakfast Establishments

You are invited to attend and provide input at this meeting hosted by Planning and Development Council.

The purpose of the zoning by-law amendment is to add provisions to Zoning By-law 2014-014 (South of Dundas Street and North of Hwy 407) and Zoning By-law 2009-189 (North of Dundas Street and South of Hwy 407), to permit and regulate short-term accommodations and to modify regulations for bed and breakfast establishments. The amendments would align with the proposed by-law to licence, regulate and govern short-term accommodations and bed and breakfast establishments.

The effect of the amendment to Zoning By-law 2014-014 includes changes to:

  • Add a definition for “short-term accommodation”;
  • Add regulations for short-term accommodations including a requirement that a short-term accommodation only be permitted in a principal residence;
  • Permit short-term accommodations, subject to obtaining a license, within residential low zones, residential uptown core zone, residential medium zones, residential high zones, mixed use zones, and accessory dwellings;
  • Prohibit short-term accommodations within the same dwelling as a bed and breakfast establishment, a lodging house, private home day care, and day care;
  • Amend the definition of “bed and breakfast establishment”;
  • Amend the definition of “lodging unit”; and,
  • Amend the regulations for bed and breakfast establishments.

The effect of the amendment to Zoning By-law 2009-189 includes changes to:

  • Add a definition for “short-term accommodation”;
  • Add regulations for short-term accommodations including a requirement that a short-term accommodation only be permitted in a principal residence;
  • Permit short-term accommodations, subject to obtaining a license, within Urban Core TUC, DUC and NUC zones, Neighbourhood Centre NC zone, General Urban GU zone, Sub-urban S zone, High Density Residential HDR zone, and second suites;
  • Prohibit short-term accommodations within the same dwelling as a bed and breakfast establishment, a lodging house, private home day care, and day care;
  • Amend the regulations for bed and breakfast establishments.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to Council c/o the Town Clerk at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 or at TownClerk@oakville.ca  before the by-law is passed:

  • the person or public body is not entitled to appeal the decision of the Town of Oakville Council to the Ontario Municipal Board; and
  • the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.

Any submission to the Planning and Development Council, either in hard copy or in electronic format, must be forwarded to the Clerk's department for receipt no later than noon on January 15, 2018, to ensure its availability to the Members of Council at the meeting. Individuals making oral submissions at the public meeting are requested to submit a written outline of the submission to the Town Clerk.  All submissions should include the full name and address of the presenter.
