Notice of intention to pass Amending By-law to Remove a Holding Provision "H" at 58 and 62 Shepherd Road

The proposed application is to remove the Holding Provision from Zoning By-laws 2014-014 as amended. The “H” Holding Provision was placed on these lands to ensure that:

  • That sufficient water and wastewater capacity is available for development to proceed and/or an  implementation plan has been put in place to address any pumping station upgrades and improvements required to accommodate additional flows in the Shepherd Road Pumping Station drainage area.
  • Registration on title of a Section 37 Agreement per the Planning Act.
  • A Ministry of Environment acknowledged Record of Site Condition, certified by a Qualified Person as defined in Ontario Regulation 153/04, is provided to the satisfaction of the Regional Municipality of Halton.”

The removal of the “H” Holding Provision is a mechanism to ensure that the above conditions are fulfilled prior to the development of the lands in accordance with the approved Zoning, and as such there are no third party rights of appeal on the removal of the Holding Provision.

The subject land, is located east of Kerr Street on the south side of Shepherd Road.
