The purpose of the application is to remove the “H16” Holding Provision from Zoning By-law 2009-189 from the subject lands. The “H” Holding Provision was placed on these lands to ensure that:

“the ultimate channel for West Morrison Creek, ultimate berm, and ultimate pond outlet for Pond 22A have been completed and certified to the satisfaction of the Town of Oakville and Conservation Halton.”

The removal of the “H” Holding Provision is a mechanism to ensure that the above condition is fulfilled prior to issuance of building permits for the affected portion of the subdivision.

There are no third party rights of appeal on the removal of the Holding Provision.

The subject land is located north of Dundas Street East and east of Sixth Line.
