Notice of passing of a proposed official plan amendment and proposed zoning by-law amendment at 115 Trafalgar Road

On Monday, December 4, 2023, Town Council passed By-law 2023-143, which adopted Official Plan Amendment 60, under section 17(23), of the Planning Act, R.S.O. 1990, c. P.13, as amended and passed Zoning By-law 2023-144 under section 34 of the Planning Act.

The purpose and effect of these amendments is to permit a six-storey apartment building with 12 residential units, three commercial units at grade along Trafalgar Road, and parking below grade with access from Trafalgar Road.

The subject lands are located on the southeast corner of Church Street and Trafalgar Road.

At this time there are no other applications, under the Planning Act, R.S.O. 1990, c. P.13, as amended, pertaining to the subject land.

Council’s decision reflects that the comments from the public have been appropriately addressed.

Any appeals to the proposed official plan amendment or zoning by-law amendment must be filed with the Town Clerk, 1225 Trafalgar Road, Oakville, ON, L6H 0H3, setting out the reasons for the appeal and the specific part of the proposed official plan amendment to which the appeal applies; and must be accompanied by the fee required by the Ontario Land Tribunal. The proposed official plan amendment is exempt from approval by the Regional Municipality of Halton. The decision of the Town of Oakville Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Only individuals, corporations or public bodies may appeal a decision of the Town of Oakville Council or a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted or before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
