Notice of Refusal for a Proposed Zoning By-law Amendment and Draft Plan of Subdivision for 3069 Dundas Street West and 3278 Regional Road 25 Palermo Village Corporation

Council has made a decision to refuse the applications for a zoning by-law amendment and draft plan of subdivision submitted by Palermo Village Corporation under sections 34 and 51, of the Planning Act, R.S.O. 1990, c. P.13, as amended on Monday, December 18, 2023.

The purpose and effect of these applications are to develop 47 hectares of land with a mix of residential, institutional, commercial, employment, natural heritage and open space uses.

The subject property is located north of Dundas Street West, south of Highway 407, and generally west of Regional Road 25 and Old Bronte Road.

Council refused this application for the reasons set out in the Staff Report presented to Council on December 18, 2023.

There were no written or oral submissions for Council to consider when making their decision.

Any appeals to the proposed zoning by-law amendment must be filed with the Town Clerk at 1225 Trafalgar Road, Oakville, ON, L6H 0H3; must set out the reasons for the appeal; and must be accompanied by the fee required by the Ontario Land Tribunal. A copy of the appeal form is available from the Ontario Land Tribunal website. 

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

At any time before the approval of the final plan of subdivision, appeal any of the conditions imposed by the approval authority to the Tribunal by filing a notice of appeal with the approval authority: i.  the applicant; ii.  any public body that, before the approval authority made its decision, made oral submissions at a public meeting, if one was held, or written submissions to the approval authority; iii.  the Minister; iv.  the municipality in which the subject land is located, or the planning board in whose planning area it is located; or v.  if the subject land is not located in a municipality or planning area, any public body.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed or before the decision of the approval authority was made on the draft plan of subdivision, the person or public body made oral submissions at a public meeting or written submissions to the Town of Oakville Council c/o the Town Clerk (at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 or at TownClerk@oakville.ca) or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

The decision of Council is final if a notice of appeal is not received before or on the last day to appeal.
