Notice of Intention to Pass Amending By-law to Remove a Holding Provision “H”


The proposed application is to remove the Holding Provision from Zoning By-law 2009-189 as amended. The “H” Holding Provision was placed on these lands to ensure that:

a) That water and wastewater Servicing Allocation has been secured for the subject lands and the proposed development through Halton Region; and that Halton Region provides correspondence indicating that sufficient water and wastewater servicing allocation has been secured to support the development.

The removal of the “H” Holding Provision is a mechanism to ensure that the above condition is fulfilled prior to the development of the lands in accordance with the approved Zoning, and as such there are no third party rights of appeal on the removal of the Holding provision.

The subject property is generally located north of Dundas Street, west of Ninth Line.

These lands are also subject to the zoning application Z.1307.04.

The removal of the “H” Holding Provision is a mechanism to ensure that the above condition is fulfilled prior to the development of the lands in accordance with the approved Zoning, and as such, there are no third party rights of appeal on the removal of the Holding provision.
