Notice of Meeting

Monday, May 16, 2022 at 6:30 p.m.

You are invited to attend and provide input at this videoconferencing meeting hosted by Planning and Development Council.

Due to the COVID-19 emergency, attendance at Town Hall is restricted and public meetings are being held by videoconference only. Instructions on how to view the meeting or participate by written submission, videoconference or telephone are provided below.

Council will be receiving comments from the public with respect to a settlement offer in the appeal to the Ontario Land Tribunal from Council’s passing of a town-initiated zoning by-law amendment (By-law 2021-157) passed on December 22, 2021 (OLT File No. OLT-22-002121). The appeal seeks the repeal of By-law 2021-157 and the restoration of the height regulations previously approved by Council through By-law 2021-021 on February 8, 2021.

THE SETTLEMENT OFFER – proposes a nine (9) storey building that fits within the 31 m height limit imposed by By-law 2021-021. The top 3 storeys would be subject to the provision of community benefits through bonusing under section 37 of the Planning Act as it read prior to September 18, 2020. Additional information with respect to the settlement offer may be found on the Town's development applications page. Previous staff reports related to By-law 2021-021 and By-law 2021-154 may be found in the agendas for the Planning and Development Council meetings of February 8, 2021 and December 22, 2021 available on the town’s website.

The subject land is a vacant property located at the northwest corner of Trafalgar Road and Glenashton and had been part of the former Public Works Site (2264, 2274 and 2320 Trafalgar Road).

At this time there are no other applications, under the Planning Act, R.S.O. 1990, c. P.13, as amended, pertaining to the subject lands other than an application for site plan approval (SP 1413.052/01).

Council will only be making a decision on the town’s position with respect to the proposed settlement and the appeal. The appeal will be determined by the Ontario Land Tribunal on a date to be determined.  As of the date of this notice, no hearing dates have been set. The rights of individuals to be parties in that appeal will be determined by the Tribunal in accordance with subsection 34(24.1) of the Planning Act and may be affected by whether they make submissions at this meeting. Persons or public bodies who did not make submissions to Council with respect to By-law 2021-157, before that by-law was passed, may not be added as a party to the hearing of the appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Individuals may make oral submissions at the meeting or written submissions to Council c/o the Town Clerk at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 (Dropbox is located in front of Town Hall) or at TownClerk@oakville.ca. Any submission to the Planning and Development Council, either in hard copy or in electronic format, must be forwarded to the Clerk's department for receipt no later than noon on May 16, 2022, to ensure its availability to the Members of Council at the meeting.

Individuals wishing to make an oral submission at the meeting must contact the Clerk’s Department prior to the meeting to register as a delegation and to obtain instructions on how to participate in the meeting. Requests must be made no later than noon on the day of the meeting by email to: TownClerk@Oakville.ca or call 905-815-6015. Requests to delegate will not be processed during the meeting.

All submissions should include the full name and address of the presenter.
