Notice of Passing
On Monday, May 16, 2022, Town Council passed By-law 2022-038, which adopted Official Plan Amendment 325, under section 17(23), of the Planning Act, R.S.O. 1990, c. P.13, as amended and passed Zoning By-law 2022-039 under section 34 of the Planning Act.
The subject lands are approximately 13 hectares in size and are located on the west side of Sixth Line, north of Carnegie Drive. Additional land to the west owned by Lower Fourth Development Limited and Pendent Development Limited has been included into the proposal. Access would be from Sixth Line and future extension of Preserve Drive.
The Official Plan Amendment application applies to Block 123 only of the Draft Plan of Subdivision and seeks to increase the allowable height from six storeys to eight storeys and increase the Floor Space Index (FSI) from 2 to 3.7.
The subject land is the subject of an application under the Act for a plan of subdivision (File No. 24T-20001/1316).
Council’s decision reflects that the comments from the public have been appropriately addressed.
Any appeals to the proposed official plan amendment or zoning by-law amendment must be filed with the Town Clerk, 1225 Trafalgar Road, Oakville, ON, L6H 0H3, setting out the reasons for the appeal and the specific part of the proposed official plan amendment to which the appeal applies; and must be accompanied by the fee required by the Ontario Land Tribunal. Copies of the appeal forms are available from the Ontario Land Tribunal website.
The proposed official plan amendment is exempt from approval by the Regional Municipality of Halton. The decision of the Town of Oakville Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

A notice of appeal may not be filed by an unincorporated association or group.
