Statutory Public Meeting and Recommendation Report for Official Plan amendments on February March 7, 2022

You are invited to attend and provide input at this videoconferencing meeting hosted by Planning and Development Council.

Due to the COVID-19 emergency, attendance at Town Hall is restricted and public meetings are being held by videoconference only. Instructions on how to view the meeting or participate by written submission, videoconference or telephone are provided below.

The Planning Services department will be presenting a recommendation report with respect to the proposed Official Plan Amendments at this meeting. The purpose of the proposed Official Plan Amendments is to modify the text of the Livable Oakville Plan and the 1984 Oakville Official Plan. The amendments will implement changes that have been made to the Planning Act resulting from Bill 13, Supporting People and Business Act, 2021. Bill 13 enables Town Council to delegate authority to pass bylaws that are minor in nature under section 34, Zoning By-laws, of the Planning Act to a committee of Council, or an individual who is an officer, employee or agent of the municipality, provided enabling Official Plan policy is in place.

The effect of the proposed Official Plan Amendments would enable Council to delegate the authority to pass by-laws under section 34 of the Planning Act to remove holding “H” symbols (holding by-laws), authorize the temporary use of land, buildings or structures (temporary use by-laws), and to pass housekeeping bylaws for the purpose of making clerical or other changes to assist in the interpretation of the zoning by-law, to a committee of Council, or an individual who is an officer or employee of the municipality. The amendment would also add general policies to the 1984 Oakville Official Plan for guidance on temporary use by-laws.

The Official Plan Amendments would apply to all lands within the Town of Oakville.

The proposed Official Plan Amendments would allow for updates to the Town of Oakville By-law 2021-077, a by-law to delegate certain powers and duties under the Municipal Act, 2001, S.O. 2001 c.25, the Planning Act, R.S.O. 1990 c. P. 13, and other Acts.

If a person or public body would otherwise have an ability to appeal the decision of the Town of Oakville to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Council c/o the Town Clerk at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 (Dropbox is located in front of Town Hall) or at TownClerk@oakville.ca before the Official Plan Amendments are adopted, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to Council c/o the Town Clerk at the Town of Oakville, Clerk’s department, before the proposed Official Plan Amendment is adopted, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Any submission to the Planning and Development Council, either in hard copy or in electronic format, must be forwarded to the Clerk’s department for receipt no later than noon on March 7, 2022, to ensure its availability to the Members of Council at the meeting. Individuals wishing to make an oral submission at the public meeting are strongly encouraged to contact the Clerk’s Department by noon on Friday, March 4, 2022, by email to: TownClerk@Oakville.ca or call 905-815-6015 to register as a delegation and to obtain instructions on how to participate. Requests to participate electronically will also be received during the meeting to ensure that those watching the live stream will be given the opportunity to speak. Instructions will be given on how to speak to an item during the live stream of the meeting.

All submissions should include the full name and address of the presenter.
