What is proposed?
The purpose and effect of the application is to amend the Zoning By-law to rezone the property from Industrial, Special Provision 4 (E3 sp:4) to a site-specific Urban Core Mixed Use (MU4 sp:453, H:75) to facilitate the proposed development.
The proposal consists of two mixed-use blocks containing four high-rise towers. Blocks 1 and 2 each contain two towers that are a maximum of 21 and 24 storeys in height, on a shared six-storey podium with underground parking. Overall, the proposed development consists of approximately 1,191 residential units, 2,550 square metres of retail/commercial space, a 1,355 square metre daycare, and the conveyance of two public roads. The overall density proposed is 4.78 FSI for the entirety of the subject lands.
Holding provisions are also recommended related to studies and materials required to be completed and implemented to the satisfaction of the Town in advance of construction include the following: noise study, land use compatibly study, air quality study, wind study, detailed design plan, urban design brief, hydrogeological study, geotechnical study, Environmental Site Assessment, record of site condition and letter of reliance, intersection design, conveyance of public roads, commitment to construction of the public roads and related infrastructure and confirmation of adequate servicing.

If a person or public body would otherwise have an ability to appeal the decision of Town of Oakville Council to the Ontario Land Tribunal, but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town Clerk before the proposed zoning by-law amendment is passed, the person or public body is not entitled to appeal the decision. Persons who may otherwise have an ability to appeal the passing of a zoning by-law amendment are limited to persons listed in subsection 34(19) of the Planning Act.
If a person or public body does not make oral submissions at a public meeting or make written submission to Town of Oakville Council before the proposed zoning by-law amendment is passed, the person or public body may not be added as a part to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
