Interim Control By-law 2026-129 was passed by Council for the Town of Oakville on August 11, 2026, under section 38 of the Planning Act, R.S.O. 1990, c. P.13, as amended, to be in effect for a period of one year from the date of passing, being August 11, 2027.
The purpose of Interim Control By-law 2026-129 is to direct a study be undertaken for data centres, enterprise computing facilities, and similar high-intensity digital processing facilities within the Business Employment, Industrial and Business Commercial designations, and the Employment District designation including lands designated Parkway Belt West lands. Town Council directed that the study reviews the applicable Official Plan policies and Zoning By-law regulations and analyse appropriate regulations to mitigate potential adverse effects associated with these forms of development, including noise, vibration, emissions and land use compatibility.
Any appeals to this Interim Control By-law must be filed with the Town Clerk at 1225 Trafalgar Road, Oakville, ON L6H 0H3 within 50 days after the date of the passing of the by-law; must set out the objection to the by-law and the reasons in support of the objection; and must be accompanied by the fee required by the Ontario Land Tribunal. A copy of the appeal form is available from the Ontario Land Tribunal website.
Any person or public body who was given notice of the passing of the by-law may appeal to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
The last day for filing a notice of appeal is October 1, 2026.
