What was passed?

Council for the Town of Oakville approved By-law 2026-018 to adopt Official Plan Amendment 077 under section 17(23) of the Planning Act, R.S.O. 1990, c. P.13, as amended. 

The proposed Official Plan Amendment (OPA) will add policies to the Livable Oakville Plan that enables the Town to implement Inclusionary Zoning within Protected Major Transit Station Areas (PMTSAs) (such as Midtown Oakville and the Bronte GO growth areas) identified in the Official Plan.

Related applications:

The OPA enables the use of a Planning Act tool. The tool would apply only to PMTSAs, see the Town's Development Application webpage for active applications within Midtown Oakville and Bronte GO growth areas.

Legal notice

Any appeals to the proposed OPA must be filed with the Town Clerk at 1225 Trafalgar Road, Oakville, ON L6H 0H3; must set out the reasons for the appeal; and must be accompanied by the fee required by the Ontario Land Tribunal. A copy of the appeal form is available from the Ontario Land Tribunal website.

Pursuant the Planning Act, section 17 (24.1.3) the Minister of Municipal Affairs and Housing may appeal the decision of Council in respect of official plan policies that authorize Inclusionary Zoning.

The proposed OPA is exempt from approval by the Minister of Municipal Affairs and Housing. The decision of Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

If a person or public body would otherwise have an ability to appeal the decision of Council to the Ontario Land Tribunal, but the person or public body did not make written comments or oral submissions before the official plan amendment was adopted, the person or public body may not be added as a party to the hearing unless in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party. Persons who may otherwise have an ability to appeal an adoption of an official plan amendment are limited to persons listed in subsection 17(24) of the Planning Act.

The last day for filing a notice of appeal is June 15, 2026.
