Bill 109: More Homes for Everyone Act

Official Plan Amendments to implement changes made to the Planning Act resulting from Bill 109.

Official Plan Amendments 47 and 328

Bill 109 made changes of the Planning Act regarding site plan control. The changes included new rules about consultations with municipalities before plans and drawings for site plan are submitted for approval and respecting completeness of site plan applications.

The Official Plan Amendments (OPAs) respond to these changes by updating the town’s implementation policies in both the Livable Oakville Plan and 1984 Oakville Official Plan (North Oakville Secondary Planning Area). The amended policies ensure the pre-consultation and complete application process for site plan applications will continue as per current town practice.

A statutory public meeting about the proposed OPAs was held on July 11, 2022 at Planning and Development Council. OPA 47 and OPA 328 came into effect on December 13, 2022.

Official Plan Amendments 53 and 329

Bill 109 made changes to the Planning Act by providing rules respecting when municipalities are required to refund fees in relation to processing times of development applications.

The proposed Official Plan Amendments respond to these changes by updating the town’s implementation policies in both the Livable Oakville Plan and 1984 Oakville Official Plan (North Oakville Secondary Planning Area).

The amended policies would put into effect the existing town practice to ensure that the public would be consulted prior to the submission of a proposed official plan amendment, zoning by-law amendment, or draft plan of subdivision.

A statutory public meeting and recommendation meeting about the proposed OPA 53 and proposed OPA 329 was held on December 5, 2022 at Planning and Development Council. OPA 53 and OPA 329 are appealed to the Ontario Land Tribunal.
